1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and INERTIA PRIME LLC, a Wyoming limited liability company with its registered address at 30 N Gould St STE R, Sheridan, WY 82801, USA ("we", "us", or "our"), which operates Santa AI Video at santaaivideo.com. By accessing our website, creating an account, uploading a photo, or purchasing a video pack, you expressly agree to be bound by these Terms and our Privacy Policy.

If you do not agree to all terms and conditions herein, you must immediately cease accessing or using our services.

2. Service Description & AI Video Generation

Santa AI Video provides a cloud-based service that turns a single photo of your home into a short, personalized "Santa caught on camera" video. You upload one photo (JPG, PNG, or WebP, up to 5MB), choose one of our Santa scenes and the date shown on the camera overlay, and our AI pipeline renders a short (about 15-second) video featuring Santa Claus in your space. A free watermarked preview image may be offered before purchase.

• Scene Format — Each generation produces a short video based on one of the predefined "Santa caught on camera" scenes offered on the website. We do not offer free-form prompts or video editing tools.
• Non-Deterministic Outputs — Generative AI models produce outputs probabilistically. We do not guarantee that a generated video will meet specific aesthetic standards, be completely error-free, or be identical across repeated generations from the same photo.
• Service Evolution — We continuously optimize our models, scene design, and user interface, and reserve the right to modify or adjust service parameters with reasonable notice where feasible.

3. User Accounts & Security

• Eligibility — You must be at least 18 years old or have reached the legal age of majority in your jurisdiction to create an account and purchase video packs.
• Account Confidentiality — You are responsible for safeguarding your login credentials and for all activities conducted under your account. You must immediately notify us of any unauthorized account access.
• One Account Per User — Automated creation of multiple accounts or exploiting introductory offers is strictly prohibited.

4. Video Packs, Credits, and Billing

• One-Time Video Packs — Access to video generation is metered via credits sold in one-time packs (for example, 1 video for $7.99, 3 videos for $16.99, or 1 HD video for $12.99; the prices shown at checkout apply). We do not sell subscriptions and no purchase renews automatically.
• Credit Consumption — One credit is deducted per generated video. Credits remain valid for 365 days from the date of purchase.
• Failed Generations — In the event of an unrecoverable system or provider failure during video generation, the deducted credit is automatically returned to your balance.
• Free Remake — Each paid video includes one free remake if the first result does not look right.
• Refunds — Refunds are handled under our Refund Policy. Unused credits may be refunded if you request it within 14 days of purchase.
• Payments — Payments are processed by third-party payment processors. We do not store full payment card numbers on our servers.
• Price Adjustments — We reserve the right to adjust pack pricing, with prior notification displayed on our pricing page.

5. Ownership & Intellectual Property Rights

• Your Uploaded Photo — You retain full ownership of and responsibility for any photo you upload to the platform. You represent that you possess the necessary rights and authorizations for all uploaded content, and that the photo does not depict other persons without their consent.
• Generated Videos — Subject to your compliance with these Terms and payment of the applicable credits, you receive full personal and commercial usage rights to videos generated via your account, to the extent permitted by applicable intellectual property law. Your videos are private to your account and downloadable.
• Platform IP — All platform code, user interfaces, branding, graphics, logos, the Santa scene design, and proprietary workflows remain our exclusive property and are protected under international copyright and intellectual property treaties.

6. Content Standards & Prohibited Categories (AUP)

You agree that when uploading photos and generating videos on our platform, you will strictly comply with applicable laws and ethical standards. You are strictly prohibited from uploading, generating, storing, soliciting, or distributing content falling into the following six prohibited categories:

1. Pornography / NSFW — Strictly prohibits any pornographic content, sexually explicit or not-safe-for-work (NSFW) material, adult sexual acts, depiction of genitalia, sexually suggestive material, as well as non-consensual sexual content or non-consensual intimate imagery (NCII).
2. Violence / Gore — Strictly prohibits content depicting extreme gore, physical mutilation, animal cruelty, inciting or promoting suicide or self-harm, terrorism, or violent extremism.
3. Hate Speech — Strictly prohibits discriminatory, derogatory, hateful, threatening, harassing, or cyberbullying material targeting any individual or protected group based on race, ethnicity, religion, gender, sexual orientation, age, or disability.
4. Child Sexual Abuse Material (CSAM) — Absolute zero-tolerance policy. Uploading, generating, soliciting, hosting, or disseminating any child sexual abuse material, child sexual exploitation and abuse (CSAM / CSAE), minor nudity, or content endangering minors is categorically prohibited. Violations will lead to immediate, permanent account termination and referral to law enforcement authorities and the National Center for Missing & Exploited Children (NCMEC).
5. Deepfakes / Impersonation — Strictly prohibits uploading photos of real individuals without their consent, generating unauthorized realistic likenesses or impersonations of people or entities, or engaging in fraud, political manipulation, or distributing severe disinformation.
6. Copyright & Trademark Infringement — Strictly prohibits uploading or generating content that infringes upon third-party copyrights, registered trademarks, trade secrets, patents, or other intellectual property rights.

Furthermore, you may not use the services for reverse engineering, malware compilation, cyberattacks, scraping private APIs, or attempting to bypass system guardrails and rate limits.

7. Platform Content Moderation Mechanism

To maintain a safe and lawful platform, we implement a multi-layered content moderation architecture:

• Pre-Generation Automated Filtering: Uploaded photos are analyzed in real time via automated safety filters and guardrails to detect and block prohibited imagery prior to generation.
• Post-Generation Moderation: Generated videos undergo automated safety evaluation to prevent prohibited visual content from being displayed or stored.
• Human Review: Ambiguous, high-risk, or user-flagged uploads and generations are escalated to our dedicated trust and safety team for manual inspection and determination.

8. User Reporting Channel & Violation Enforcement

• Reporting Mechanism: If you discover any content or conduct on our platform that violates these Content Standards or infringes your rights, please report it immediately to our support team with the subject line "[Content Moderation Report]". Please include:
  1. The content identifier (order number, task ID, or video link);
  2. The violation category (e.g., CSAM, infringement, non-consensual imagery) and a brief description;
  3. Supporting screenshots or evidence, if applicable.
• Response Timeline: Our trust and safety team reviews reports promptly, typically within 24 to 48 hours upon receipt.
• Enforcement Actions: Upon confirming a violation, we reserve the right to take appropriate disciplinary actions based on severity, including:
  1. Immediate removal or deletion of the offending content;
  2. Temporary restriction or suspension of generation features;
  3. Permanent account termination with forfeiture of unused credits without refund;
  4. In cases involving CSAM or severe illegality, referral to law enforcement and reporting agencies (such as NCMEC).
• Appeals: If you believe your account was restricted or terminated due to an error or false positive, you may submit an appeal to our support team with supporting explanation and evidence for re-evaluation.

9. Disclaimer of Warranties

The platform, AI models, and all generated materials are provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

In no event shall our platform, its affiliates, directors, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or business goodwill) arising out of your access to or inability to use our services, even if advised of the possibility of such damages.

11. Account Termination

We reserve the right to suspend, restrict, or terminate your access to the platform at any time with or without cause if we reasonably determine that you have violated these Terms or engaged in unauthorized activity. You may discontinue your use of the service and delete your account at any time via your account settings.

12. Modifications to These Terms

We may update these Terms periodically to reflect product updates or legal obligations. We will notify users of significant amendments by updating the "Last Updated" date above. Continued use of our platform after updates indicates your agreement to the revised Terms.

13. Governing Law and Disputes

These Terms, and any dispute arising out of or relating to them or to the service, are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law principles. Subject to any mandatory rights you have as a consumer in your place of residence, you agree that the state and federal courts located in Wyoming have exclusive jurisdiction over any such dispute. Before starting any formal proceeding, please contact us so we can try to resolve the issue informally.
